In this document the term “Hootle” refers to the entity of the Hootle software application, developed by Golfopotamus, LLC along with its services, products, intellectual property, logos, licenses, copyrights, software, patents, trademarks, etc.
In this document Golfopotamus, LLC will be referred to as “The Company”, “Company” or “Governing Company”.
In this document Golfopotamus, LLC’s software application “Hootle” will be referred to as “The Service” or “Service”.
If you are one of the many people who have decided to download the Hootle software application and/or use a Hootle product and/or service, you are agreeing to be bound by constraints, legal notification, and clauses that are of or used by Golfopotamus, LLC. (Golfopotamus, LLC is a Delaware Company)
The following Terms of Use govern your use of Hootle the software application, including, but not limited to: Hootle products, Hootle services and other Hootle related tools, objects, software and usable features. When you create a Hootle account with us, or use Hootle services and/or products, you agree to all of the following terms stated in this document and on other Hootle legal documentation found on the hootleapp.com or hootle.io website, or on the information found on the Hootle software application.
The Hootle Service is a product provided to you by Golfopotamus, LLC. This Privacy Policy therefore constitutes an agreement between you and Golfopotamus, LLC.
By using Hootle, you agree that disputes between you and The Company will be resolved through individual dealings with our customer service team at Hootle. By using Hootle, you waive your right to sue Hootle or The Company. By using Hootle, you agree to opt out of any legal pursuit of Hootle or The Company in the form of lawsuits, class action lawsuit, arbitration, etc.
This policy describes information and data we collect and/or process to support The Company and the Service.
What types of Data do we collect.
Information that you provide to the Service. All uploaded, downloaded, filtered, used, compiled, or decompiled data and source code is used by The Company to better advance the Service’s features for future versions and to better advance our understanding of users, customers, advertisers and vendors.
Information that the Internet Provides. We perform web research to enhance the data that is already being filtered and used for informative purposes in order to better enhance the software that our Service delivers to its users.
Information from other entities, where applicable. If other entities, corporations or business allow us approval for information use, about users, vendors, advertisers or other information to The Company, we may decide to use this information for The Company’s uses and for software enhancements.
Transactional Advertiser Information. We will keep data on expenses and costing of advertising in order to help our advertisers have a track record of purchases with The Company.
Device Data.
Information supplied by the mobile or stationary device developer. Whether on Apple or Android, we will be allowed to only use data that is accessible through the device’s services that the developer has provided. The scope of information we may use has already been shrunk to the allowable maximum of data provided to your developer provider and/or their phone service provider (i.e. AT&T or Verizon).
Information accessible through your mobile or stationary device. We will keep recorded data that is allowed to be accessed through use of a mobile or stationary device, which is intended to only be allowable as per your mobile or stationary device’s developer preferences and settings.
Device operational information. We may use information that you allow us to provide through acceptance in-app and in settings on your device such as, but not limited to: gyroscope services, location services, bluetooth services, notification services and sound services.
Reason for Usage.
Improving Products and Services. Information exchange, development, enhancement, depiction, deciphering and analysis all allow for our product(s) and/or service(s) to be improved upon for the enjoyment and use of the users, vendors and advertisers.
Community Usage. Some information you and others provide is vital to the establishment and fostering of a great and happy community of users. By allowing us to develop with you, we are advancing technology not only to enhance the software, but to understand the users better and to provide relevant content and accessible features for you, the user, in the community.
Safety and Cautionary Usage. Some information provided can be used to combat issues that may or may not be irrelevant to you or other users, or any users using the Service.
Feedback Usage. Some information provided to us will be used in helping resolve issues that you may have while using the Service.
Partner Data Transfer and Information Sharing.
Information Exchange. For the betterment of the software, we may help other entities develop usage of information, where applicable, in order to benefit one or both parties in pursuit of, but not limited to, enhancing the technological features and community of one or of both parties’ Service or services.
Third Party Partners. When, and where applicable, third party vendors or advertisers are involved in data and/or information usage with The Company or the Service, The Company and the Service will provide as much security and safety measures as applicable and/or possible when determining issues, or when determining where data or information usage is required in developing further software, delivering advertisements, and/or other partnering purposes
Other Data Transfer. If ownership or restructuring of The Company or the Service is initiated or determined, some or all data under ownership can be transferred without notice to the majority stakeholder or to the entity applicable.
Legal Requests. If a legal request or law enforcement request is ensued for data and/or information of the Service or of The Company, we may provide the requested data and/or information where applicable.
Academic Requests. If academic request or verified research request is ensued for data and/or information of the Service or of The Company, we may provide the requested data and/or information where applicable.
Deleting Data.
Removing an Account. If you would like to remove all or most of your information provided to the Service, you may delete your account. This does not ensure all metadata and data have been deleted, but the software will recognize not to continue data collection, unless otherwise stated. The data you provide may remain backlogged with The Company and the source code of the Service for an undefined period after removal of an account or source code specific deletion of data.
Updates to Policy.
We reserve the right to change the Service, documentation, policies, etc. at any time to advance causes of The Company. We will likely notify you of the newest editions of terms of use and other company and Service policies, unless changes to the documentation occurs that is deemed unnecessary for notification to user base. By using our Service, you are bound by any and all terms stated through use of our website, service(s), product(s) or materials distributed or attached to The Company. This document and policy are placed into effect as per revision 4.4 of August 25, 2019.
